Terms of Service

These terms apply between you, the customer, and Top Tuning Limited.

“We”, “us” and “our” means Top Tuning Limited.

“You” and “your” means the customer.

By paying your £50 booking deposit, you confirm that you have had the opportunity to read and agree to these Terms of Sale.

1. £50 Booking Deposit

A £50 booking deposit is required to secure your appointment with Top Tuning Limited.

The £50 deposit is credited towards the final price of the booked work.

The deposit reserves appointment time and contributes towards administration, scheduling, travel planning and losses that may arise if an appointment is cancelled.

If you cancel your appointment, we may retain an appropriate amount of the deposit to cover reasonable losses directly resulting from the cancellation, subject to your statutory rights.

Where appropriate, we may allow your deposit to be transferred to a rearranged appointment.

If Top Tuning Limited cancels the appointment and a suitable alternative appointment cannot be agreed, your deposit will be refunded.

Nothing in this section affects your statutory consumer rights.

Government consumer guidance states that businesses can retain deposits or impose cancellation charges only in certain circumstances, and that such terms must be fair and reasonable. [gov.uk], [gov.uk]

2. ECU Remapping – Vehicle Condition

ECU remapping depends on the vehicle being in suitable working order and its engine, drivetrain, sensors and associated components operating correctly.

If the engine, turbocharger, clutch, gearbox, injectors, sensors or other mechanical or electrical components are worn, damaged or operating incorrectly, increasing engine performance may expose or accelerate an existing problem.

You must tell us before work begins if you are aware of any existing:

• Mechanical faults
• Electrical faults
• Engine management faults
• Warning lights
• Performance problems
• Previous ECU modifications
• Previous remapping or tuning

We reserve the right to refuse or postpone work if we believe the vehicle is not suitable for the requested service.

3. Diagnostics Before Remapping

We perform DTC and engine fault-code checks before remapping to assess the vehicle and identify relevant recorded faults.

Diagnostic checks do not constitute a complete mechanical inspection and cannot guarantee that every existing, intermittent or developing mechanical or electrical problem will be detected.

Where significant faults are identified, we may advise that they are repaired before remapping.

If a standard remap does not respond as reasonably expected during our checks, we may restore the vehicle’s original ECU file.

Where appropriate, we will refund the remap price less the applicable booking deposit and any other reasonably incurred or previously agreed charges.

4. Remap Warranty

Top Tuning Limited provides a lifetime warranty on the remap file supplied and installed by us, subject to these Terms of Sale.

The warranty relates to our ECU calibration file. It does not constitute a warranty covering the vehicle or its mechanical and electrical components.

Our remap warranty does not cover components including:

• Engine components
• Turbochargers
• Clutches
• Gearboxes
• Injectors
• Pumps
• Sensors
• Wiring
• Batteries
• Exhaust components
• Emissions-control equipment
• Other mechanical or electrical components

If there is a problem that you believe relates directly to the remap file supplied by Top Tuning Limited, please contact us and give us a reasonable opportunity to investigate.

5. Mechanical Risk & Vehicle Wear

ECU remapping can increase engine power and torque.

The additional performance may place increased load on components including the engine, turbocharger, clutch and gearbox.

A worn component or a component approaching the end of its service life may therefore develop a fault following a performance increase.

Regular servicing and proper vehicle maintenance can help reduce the likelihood of mechanical problems.

Remapping may affect or invalidate your vehicle manufacturer’s warranty.

You should consider your vehicle’s age, mileage, condition, servicing history and any existing mechanical issues before requesting performance tuning.

6. Performance & Fuel-Economy Figures

Any quoted horsepower, torque or fuel-economy improvements are estimates and are not guaranteed.

Actual results may vary depending on factors including:

• Vehicle make and model
• Vehicle age
• Mileage
• Engine condition
• Previous modifications
• Fuel quality
• Temperature
• Vehicle load
• Tyre pressures
• Driving style
• Servicing and maintenance

Vehicles of the same make, model and engine type may still produce different results.

7. Existing or Developing Faults

Top Tuning Limited is not responsible for the cost of repairing faults that existed before our work or unrelated mechanical or electrical faults that subsequently develop.

Where our diagnostics identify an underlying issue, we may recommend additional investigation or repair before further work is undertaken.

A diagnostic scan identifies information available through the vehicle’s electronic control systems. It cannot provide a complete assessment of every mechanical component within the vehicle.

8. Emissions, Noise & Road Use

Certain specialist ECU calibrations or physical modifications may affect the operation of a vehicle’s original emissions-control equipment or exhaust characteristics.

This may include work involving:

• AdBlue/SCR
• DPF
• GPF
• OPF
• EGR
• NOx systems
• Lambda/O2 systems
• Catalytic converter-related systems
• Certain specialist ECU calibrations
• Pop & Bangs
• Hard Cut configurations
• Other exhaust or noise-related modifications

Where any requested modification would result in a vehicle no longer complying with the legal requirements applicable to its use on public roads, that service is supplied strictly for off-road, motorsport or other lawful non-road use.

Section 75 of the Road Traffic Act 1988 includes provisions concerning supplying vehicles in an unroadworthy condition and altering a vehicle so that its use on a road would be unlawful. It also contains provisions concerning circumstances where there was reasonable cause to believe that the vehicle would not be used on a road in Great Britain, or would not be used there until it had been restored to a condition in which it could lawfully be used. Section 76 contains related provisions concerning fitting and supplying vehicle parts where the resulting use of the vehicle on a road would contravene applicable construction and use requirements or involve danger. [legislation.gov.uk]

9. Off-Road & Motorsport Customer Declaration

Where you request a service that would cause the vehicle not to comply with requirements applicable to public-road use, you confirm that:

• The vehicle is intended for off-road, motorsport or other lawful non-road use.

• The vehicle will not be used on a public road in Great Britain in that condition.

• The vehicle will not subsequently be used on a public road unless and until it has been returned to a condition in which it can lawfully be used.

• You are the vehicle owner or have the owner’s authority to request the work.

• You have accurately informed us of the vehicle’s intended use.

Top Tuning Limited reserves the right to refuse any work where we have reason to believe the vehicle will subsequently be used unlawfully on a public road.

Your agreement to these Terms of Sale does not override or remove any legal responsibilities applicable to Top Tuning Limited.

Standard road-appropriate Stage 1, economy and similar remaps that do not make the vehicle unlawful for road use are not treated as off-road-only services under this section.

10. Post-Remap Checks & Support

Following a standard remap, we carry out appropriate checks to confirm that the ECU has accepted the calibration and check for relevant diagnostic faults.

If you subsequently believe there is a problem relating to the work we have carried out, you must contact us as soon as reasonably possible and allow us a reasonable opportunity to investigate.

Once we have left your location, further investigation may require you to bring the vehicle to an agreed location.

We may ask you to obtain an independent diagnosis from a suitably qualified mechanic or specialist.

Please contact us before authorising third-party work where you believe the issue has been caused by our remap.

Third-party diagnostic or repair costs will not automatically be paid by Top Tuning Limited.

Where a vehicle develops an unrelated mechanical fault, we may be able to restore the vehicle’s standard ECU calibration while repairs are carried out.

Removing a correctly functioning remap because of an unrelated mechanical problem does not automatically entitle the customer to a refund.

Reinstalling the remap following repairs may incur an additional charge depending upon the work required.

11. Virtual Reads & ECU Data

Many modern vehicles use what is known as a Virtual Read.

A Virtual Read means the file used as the basis for remapping may be an appropriate original manufacturer software file rather than a complete copy of every software modification currently contained within the vehicle’s ECU.

As a result, previous ECU modifications may not always be apparent before we carry out our work.

For example, a vehicle may have previously had:

• An ECU remap
• AdBlue/SCR software modifications
• DPF software modifications
• EGR software modifications
• Other ECU calibrations

If the current owner is unaware of these changes and the vehicle uses a Virtual Read, those previous modifications may not be present within the manufacturer file available to us.

Installing another ECU calibration can therefore overwrite a previous modification and potentially cause associated warning lights or fault codes to return.

You must tell us before work begins about any previous ECU remapping or software modifications that you know have been carried out.

If you do not know that previous work has been carried out and the information is not reasonably available through our normal processes, we cannot reasonably be expected to identify it beforehand.

We are not responsible for consequences arising solely from an undisclosed previous ECU modification that could not reasonably have been detected before our work commenced.

If additional ECU work is subsequently required, we will only perform work appropriate and lawful for the vehicle’s intended use.

12. Undisclosed Previous Remapping

In some cases, it may not become apparent that a vehicle has already been remapped until a substantial part of the tuning process has been completed.

Where an undisclosed previous remap or ECU modification prevents us from completing the booked work, a £50 charge may apply for time, travel and labour, in addition to any amount of the booking deposit that we are lawfully entitled to retain.

Where possible, we will explain the situation and your available options before carrying out further chargeable work.

13. Cancellations, Rearranging & Refunds

Your £50 payment reserves your appointment.

If you need to rearrange your appointment, please give us as much notice as reasonably possible.

Where appropriate, Top Tuning Limited may transfer your booking deposit to a rearranged appointment.

If you cancel, we may retain an appropriate amount to cover reasonable losses directly resulting from the cancellation, such as administration, reserved appointment time or other costs already reasonably incurred.

We will take reasonable steps to minimise avoidable losses.

If Top Tuning Limited cancels your appointment and we cannot agree a suitable alternative date, your deposit will be refunded.

If we cannot carry out the booked work because your vehicle has an undisclosed mechanical problem or previous modification, charges may apply for work, diagnostics, travel or time already reasonably incurred.

Nothing in this section affects your statutory consumer rights.

Current UK government consumer guidance states that deposit and cancellation terms must be fair, and that businesses are generally entitled only to amounts sufficient to reflect the losses directly resulting from a customer’s cancellation. [gov.uk], [gov.uk]

14. DPF Cleaning

Top Tuning Limited cannot guarantee that a DPF will never become blocked again following cleaning.

DPF blockage can recur for reasons outside the cleaning process, including:

• Frequent short journeys that prevent effective regeneration
• Mechanical or electrical faults preventing regeneration
• Failed or inaccurate sensors
• Excessive soot production
• Engine-related faults
• Oil contamination
• Internal DPF damage that cannot be identified during an on-car clean

We recommend appropriate vehicle diagnostics where necessary to identify problems that may be contributing to repeated DPF blockage.

Our aim is to provide an effective cleaning service, but we cannot control subsequent vehicle use, maintenance or unrelated mechanical failures.

15. DPF Cleaning Warranty

Top Tuning Limited provides a 12-month warranty on the DPF cleaning service.

If a qualifying DPF becomes blocked again within the warranty period, we will re-clean the DPF without charging for the cleaning itself, subject to the terms of the warranty.

The customer remains responsible for arranging and paying for:

• DPF removal
• DPF refitting
• Transportation where applicable
• Vehicle diagnostics
• Repairs to underlying faults
• Work performed by third parties

A DPF being cleaned under warranty must be brought to our Chippenham facility.

The warranty covers the qualifying re-cleaning service. It does not mean Top Tuning Limited accepts responsibility for the underlying reason why the DPF has become blocked again.

16. DPF Oil Contamination

Where a DPF contains a significant amount of engine oil, an additional £50 oil-contamination charge will apply.

Oil contamination requires our DPF cleaning equipment to be completely drained and cleaned before it can safely be used again.

This process takes approximately two hours and is necessary to avoid contamination of subsequent DPF cleaning work.

17. Approved Centres

Any approved centre or independent garage we recommend or work alongside operates as a separate business unless expressly stated otherwise.

Top Tuning Limited cannot accept responsibility for work independently undertaken by another business.

Payments for services are handled separately:

• Top Tuning Limited invoices for the DPF cleaning service supplied by us.

• Approved centres or independent garages invoice separately for diagnostics, removal, refitting, repairs and any other work they undertake.

Unless expressly agreed otherwise, Top Tuning Limited does not arrange bookings or obtain quotations from independent approved centres on your behalf.

18. Third-Party Costs & Losses

If you believe a problem has arisen as a direct result of work carried out by Top Tuning Limited, please contact us as soon as reasonably possible and allow us a reasonable opportunity to inspect and investigate the vehicle.

You should contact us before instructing another business to investigate or repair an alleged problem relating to our work.

We do not automatically accept responsibility for:

• Third-party diagnostic charges
• Repair bills
• Recovery charges
• Replacement components
• Vehicle hire
• Loss of vehicle use
• Loss of earnings
• Business interruption

Any liability will depend upon the circumstances and applicable law.

Nothing in these Terms of Sale excludes or restricts liability that cannot lawfully be excluded or restricted, and nothing affects your statutory consumer rights.

19. Acceptance of Terms

By paying the £50 booking deposit, you confirm that:

• You have had the opportunity to read these Terms of Sale before making your booking.

• You agree to these Terms of Sale.

• You have provided accurate information about your vehicle to the best of your knowledge.

• You have disclosed any known faults, previous remapping or ECU modifications relevant to the work requested.

• You understand that the £50 payment reserves your appointment and is credited towards the final price of the booked work.

Where off-road or motorsport-only work is requested, additional confirmation of the vehicle’s intended use may be required before we agree to undertake that work.

Acceptance of these terms does not oblige Top Tuning Limited to undertake work that we believe would be unsafe or unlawful.

Top Tuning Limited reserves the right to refuse work where we believe the vehicle is unsuitable for the requested service, where material information has not been provided, or where carrying out the requested work would be unlawful.
